The Performance Rights Act that was introduced in the past two Congresses would have imposed a performance tax on local radio stations. The MAB strongly opposed this legislation and was instrumental in preventing its passage. Currently, there is no performance tax legislation introduced in the 112th Congress.
On February 28th, the Congress introduced the local Radio Freedom Act, the pro-broadcaster, anti-performance tax resolutions. House Resolution 21 was introduced by Representatives Mike Conaway (TX-11) and Gene Green (TX-29) and has 172 co-sponsors. Senate Resolution 7 was introduced by Senators Ben Nelson (NE) and John Barrasso (WY) and has 21 bipartisan co-sponsors.
